Terms of service

1. The service

SurgeX routes API requests to third-party AI inference providers. SurgeX does not train, host or own the models it routes to, and the output of any request is produced by the provider that served it.

2. Accounts and keys

You are responsible for keeping your API keys secret and for all activity under them. Keys are stored as hashes and cannot be recovered; a lost key must be rotated. Rotation issues a replacement and keeps the previous key valid for 24 hours.

3. Credit and fees

  • Credit is purchased in advance and denominated in US dollars.
  • A platform fee is deducted once, at the time of deposit, at the rate shown on the pricing page.
  • Inference is charged at the serving provider's list price with no additional per-token markup.
  • Credit does not expire.
  • Credit buys inference. See the refund policy for whether and how it can be returned.

4. Acceptable use

You must comply with the acceptable use policy, and with the terms of every upstream provider whose models you reach through SurgeX. A provider may impose restrictions that SurgeX cannot waive on your behalf.

5. Availability

The service is provided as-is. No uptime commitment is made unless one is agreed separately in writing. Published status and latency figures are measured from real traffic and are informational, not contractual.

6. Content and responsibility

You are responsible for the content you send and for how you use what comes back. Model output can be wrong, and SurgeX makes no representation about its accuracy, fitness or legality for any purpose.

7. Suspension

Accounts may be suspended for violations of these terms, for abuse that threatens the service or its upstreams, or where required by law.

8. Limitation of liability

To the maximum extent permitted by law, liability is limited to the amount you paid in the three months preceding the claim, and neither party is liable for indirect or consequential loss. Some jurisdictions do not permit these limits, and where that is so, they apply only as far as the law allows.

9. Changes

These terms may change. Material changes will be announced before taking effect.

10. Governing law

These terms are governed by the laws of the jurisdiction in which the operating company is established.
